STUART , Justice . Jason Michael Sharp was convicted of murder made capital because it was committed during the course of a rape or an attempted rape, see 13A-5-40(a)(3), Ala. Code 1975. After a sentencing hearing, the jury recommended, by a vote of 11-1, that Sharp be sentenced to death. The trial court took the jury's recommendation and sentenced Sharp to death.
