Whether Respondent, Office of Financial Regulation, has made certain agency statements with regard to record-keeping requirements for licensed check cashers, which are agency rules as defined in section 120.52(16), Florida Statutes, but have not been adopted as rules in violation of section 120.54(1)(a), Florida Statutes; and if so, whether costs and attorney’s fees should be awarded.Petitioner did not demonstrate by a preponderance of the evidence that the agency's alleged statements were rules as defined by section 120.52(16), and not adopted as such according to section 120.54.
