The issue is whether Respondent, the City of Ormond Beach (the "City"), committed unlawful employment practices contrary to section 760.10, Florida Statutes (2009),1/ by discriminating against Petitioner based on his race or by discharging Petitioner from his employment in retaliation for engaging in protected conduct.Petitioner, a black male, failed to demonstrate that his discharge from employment was caused by anything other than his poor performance over an extended period of time.
