Whether Petitioner was terminated from his position with Respondent as a warehouse supervisor on or about August 9, 2002, on the basis of his race (African-American), in violation of Subsection 760.10(1)(a), Florida Statutes (2003).Petitioner failed to prove that his termination as warehouse supervisor was based upon his race. Respondent articulated legitimate reasons for Petitioner`s discharge because of his failure to perform his duties properly. Recommend dismissal of petition.
