The issue in this case is whether the Respondent, the Department of Insurance (the Department), has an unpromulgated agency rule not to reimburse routine defense fees at more than $85 per hour when providing for the defense of civil actions against state employees.Risk management decided it would not reimburse Petitioner`s attorney`s fees at more than $85 an hour, "which is the maximum paid for routine defense cases."
