Petitioner Brooks Builders, Inc., and Intervenor Pino- Fonticiella Construction Corp. submitted timely bids for state project number 97870-3363. Petitioner timely brought this proceeding to challenge the Department of Transportation's notice of intent to award the contract to Intervenor. Pino- Fonticiella's ore tenus motion to intervene at the commencement of the final hearing was granted.Bid protestor was successful where Department improperly allowed intended winner to submit information amending its bid after the bids were opened.
