The issues, as framed by the Administrative Complaint, are twofold: Whether Respondent committed gross negligence, incompetence, or misconduct which caused monetary harm to a customer, in violation of Florida Administrative Code Rule 64E-6.022(1)(l)2; and Whether Respondent practiced fraud or deceit by making a misleading or untrue representation to a home purchaser, or the home purchaser's agents, incident to a loan application, in violation of Florida Administrative Code Rule 64E-6.022(1)(k).Respondent's septic tank inspection and allowing a non-licensed person to sign the certification demonstrated incompetence or misconduct, resulting in harm to a customer. Respondent's license should be suspended for six months and a $1,000 fine imposed.
