The issue to be resolved in this proceeding concerns whether the above-named Respondent discriminated against the Petitioner based upon her race, in purported violation of Section 760.10, Florida Statutes.Petitioner failed to show she was qualified or more qualified than the persons promoted over her, who were outside her protected class. Respondent had a legitimate, non-discriminatory reason for its decision, based on Petitioner`s deficient performance.
