This is a proceeding pursuant to the Florida Equal Access To Justice Act, Section 57.111, Florida Statutes, and Rule 22I-6.035, Florida Administrative Code, in which the Petitioner, a prevailing party, seeks an award of attorney's fees and costs. The Respondent opposes the award on the grounds that "the actions of the agency were substantially justified or special circumstances exist which would make the award unjust."DPR was substantially jusfified in its filing of Administrative Complaint even though it later dismissed case due to uncooperative witness.
