The issues in this case are whether Respondent violated section 464.018(1)(h), Florida Statutes (2009),1/ as implemented by Florida Administrative Code Rule 64B9-8.005(2); whether Respondent violated section 456.072(1)(m), Florida Statutes; and, if so, what penalty should be imposed.Respondent engaged in unprofessional conduct and used a scheme related to her profession by misappropriating propofol from her former employer for use by her then-current employer. Recommend reprimand, fine and 3-year probation for violations.
