Whether the Department of Financial Services (the “Department”) correctly denied the unclaimed property claim submitted by Choice Plus, LLC (“Choice Plus” or “Petitioner”), on behalf of Louis Nardi as attorney-in-fact for Felicia Leggiero (“Leggiero”).Petitioner, a claims representative, did not carry its burden to prove that it was entitled to unclaimed funds for claimant. DFS had not yet made a determination of entitlement when the claimant died and her entitlement to the funds vested in her estate.
