The issues in this case are whether Respondent, Doherty Home Repair, Inc., failed to obtain workers’ compensation coverage that meets the requirements of chapter 440, Florida statutes (2017); and, if so, whether the penalty assessed in the 2nd Amended Order of Penalty Assessment was properly calculated.The Division proved by clear and convincing evidence that the Respondent failed to carry workers' compensation coverage and the Division properly calculated and assessed a fine totaling $244,964.44.
