The ultimate issue is whether IMC has provided reasonable assurance that the applicable requirements of Chapters 373 and 403, Florida Statutes, and relevant rules promulgated thereunder, have been satisfied justifying entitlement to an ERP.IMC provided reasonable assurances that its proposed phosphate mining, reclamation, and associated activities on the Manson Jenkins Property in Manasota County would not violate applicable statutes and rules and is not contrary to the public interest.
