The issue is whether Respondent discriminated against Petitioner in employment based on age or disability as prohibited by section 760.10(1)(a), Florida Statutes.Petitioner failed to prove that her demotion from charge nurse to staff nurse was due to her age. Petitioner had failed to timely complete an annual competency assessment for three of the last four years and set bad example for her staff nurses.
