RECOMMENDED ORDER

A hearing was held in the above-captioned matter, after due notice to the parties, at Fort Lauderdale, Florida, on June 29, 1976, before the undersigned Hearing Officer.

APPEARANCES

For Petitioner: Ronald C. LaFace, Esquire

Post Office Box 1752 Tallahassee, Florida

For Respondent: None

ISSUE PRESENTED

Respondent's alleged violation of Rule 21f-3.10, Florida Administrative Code.

Receipt of the Administrative Complaint and the Notice of Hearing was acknowledged by the Respondent. (Exhibit 1)

Counsel for the Petitioner announced at the commencement of the hearing that Respondent's cosmetology salon was out of business and that said Respondent possessed no personal Certificate of Registration as a cosmetologist.

Petitioner therefore interposed no objection to dismissal of the allegation.

CONCLUSIONS OF LAW

  1. Petitioner seeks to suspend or revoke Respondent's Certificate of Registration to operate a cosmetology salon No. 21999 OB for failure to display a proper sign at the entrance to the salon in violation of Rule 21f-3.10, F.A.C.

  2. In view of the fact that Respondent no longer operates a cosmetology salon and a Certificate of Registration is nontransferable the allegation should be dismissed.

RECOMMENDATION

That the allegation against Respondent be dismissed.

DONE and ENTERED this 28th day of July, 1976, in Tallahassee, Florida.
