RECOMMENDED ORDER
Pursuant to notice a hearing was held before Charles C. Adams, a Hearing Officer with the Division of Administrative Hearings, on November 24, 1976, at Conference Room 205, Building "B", 6501 Arlington Expressway, Jacksonville, Florida.

The Respondent, Rachael Ross Washington, had been mailed a copy of the hearing and Alan A. Alop, Esquire, Duval County Legal Aid Association, 205 East Church Street, Jacksonville, Florida, had been mailed a copy of the notice of hearing, having indicated his appearance as attorney. When the proceedings of November 4, 1976 were commenced attorney Marie Janiewski appeared at the hearing as a member of the Duval County Legal Aid Association Staff and indicated that she had heard from the Respondent, Rachael Ross Washington, and that the Respondent had indicated that she would not be in attendance at the hearing, did not wish a hearing and did not wish to pursue the case.
FINDING OF FACT
Rachael Ross Washington is a licensed practical nurse with the Florida State Board of Nursing, holding license no. 15136-1, and held such license from July, 1975 up to and including the date of the hearing.
On or about July 27, 1975, the Respondent, Rachael Ross Washington, while on duty as a licensed practical nurse at Baptist Memorial Hospital, Jacksonville, Florida, signed out for a drug to wit: Talwin 50 mg, for a patient named Mae Retha Reed, a patient in her charge, when there was no doctor's order for such a drug to be administered to said patient.
On or about July 27, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at Baptist Memorial Hospital, Jacksonville, Florida, signed out for a drug, to wit: Talwin 50 mg, for a patient named Ada L. Merit, a patient in her charge, when there was no doctor's order for such drug to be administered to said patient.
On or about July 31, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at Baptist Memorial Hospital, Jacksonville, Florida, signed out for a drug, to wit: Talwin 50 mg, for a patient in her charge named V. Brooks, when there was no doctor's order for said drug to be administered to said patient.
On or about August 12, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at Baptist Memorial Hospital, Jacksonville, Florida, signed out for a controlled drug, to wit: Talwin 50 mg, for a patient named G. Chauncey, a patient in her charge, when there was no doctor's order for such a drug to be administered to said patient.
On or about August 21, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse, at Baptist Memorial Hospital, Jacksonville, Florida, signed for a controlled drug in the form of tablets of valium, 10 mg for a patient named Isabel M. Flack, a patient in her charge, when there was no doctor's order for such drug to be administered to said patient.
On or about August 21, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse, at Baptist Memorial Hospital, Jacksonville, Florida, signed for a controlled drug to wit: 10 tablets of Valium, 10 mg, when there was no doctor's order for such drug to be administered to said patient.
On or about August 24, 1975, the Respondent, Rachel Ross Washington, while employed as a licensed practical nurse at the Baptist Memorial Hospital, Jacksonville, Florida, signed out for twelve tablets of a controlled drug, to wit: Valium 10 mg for a patient named Eno K. Hallman, a patient in her charge, when there was no doctor's order for such drug to be administered to said patient.
On or about August 24, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at the Baptist Memorial Hospital, Jacksonville, Florida, signed out for twelve tablets of a controlled drug, to wit: Valium 10 mg, for a patient named Karen A. Parker, a patient in her charge, when there was no doctor's order for such drug to be administered to said patient.
On or about August 24, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at the Baptist Memorial Hospital, Jacksonville, Florida, signed out for six tablets of a controlled drug, to wit: Doriden for a patient named Howard B. Shivers, Sr., a patient in her charge, when there was no doctor's order for such a drug to be administered to said patient.
On or about August 21, 1975, the Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at the Baptist Memorial Hospital, Jacksonville, Florida, signed out for a controlled to wit: Valium 10 mg, for a patient named Hellen Stone, a patient in her charge, when there was no doctor's order for such a drug to be administered to said patient.
On or about August 25, 1975, Respondent, Rachael Ross Washington, while employed as a licensed practical nurse at the Baptist Memorial Hospital, Jacksonville, Florida, signed out for a controlled drug, to wit: Valium 10 mg, for a patient named Karen A. Parker, a patient in her charge, when there was no doctor's order for such a drug to be administered to said patient.
These drugs as signed out for the named patients listed above were never administered to said patients.
CONCLUSIONS OF LAW
The Division, of Administrative Hearings has jurisdiction in this cause.
It is concluded as a matter of law that based upon the facts as shown, the Respondent, Rachael Ross Washington, has violated s464.21(1)(p), F.S.
It is recommended that the license held by the Respondent, Rachael Ross Washington, to be a licensed practical nurse in the State of Florida, number 15136-1, be revoked.
