ADMINISTRATIVE COMPLAINT
Petitioner, DEPARTMENT OF HEALTH, hereinafter referred to as “Petitioner,” files this
Administrative Complaint before the Board of Speech Language Pathology and Audiology, against
, HELEN TECHLER, hereinafter referred to as “Respondent,” and alleges:
1. Effective July 1, 1997, Petitioner is the state agency charged with regulating the profession of
audiology pursuant to Section 20.43, Florida Statutes, Chapter 456, Florida Statutes (formerly
Chapter 455, Part II; see Chapter 2000-160, Laws of Florida), and Chapter 468, Florida
Statutes. Pursuant to Section 20.43(3)(g), Florida Statutes, the Department has contracted
with the Agency for Health Care Administration to provide consumer complaint,
investigative, and prosecutorial services required by the Division of Medical Quality
Assurance, councils, or boards, as appropriate.
2. Respondent is, and has been at all times material hereto, an Audiologist, licensed in the State
of Florida, having been issued license number AY 578.
3. The last address of record of the Respondent is 1539 San Charles Drive, Dunedin, Florida.
4. On April 26, 2000, the Respondent performed an audiologic examination of patient PR.
5. In response to a formal request from the investigator for the Agency for Health Care
Administration (AHCA), the Respondent provided the testing information of this
examination. ; :
6. Section 468.1225(1), Florida Statutes, sets forth the minimum procedures to be performed,
when indicated, by an audiologist when fitting and selling a hearing aid. These procedures
include: pure tone audiometric testing by air and bone conduction to determine the type and
degree of hearing deficiency; effective masking; and appropriate testing to determine speech
reception thresholds, speech discrimination scores, the most comfortable listening levels,

uncomfortable loudness levels, and the selection of the best fitting arangemnt gona

7. The testing data received by the AHCA was deficient in that there was no roti 1.0

masking in bone conduction.
9. The testing data received by the AHCA was deficient in that there was no recordation of
uncomfortable listening levels.
Based on the foregoing, the Respondent is subject to discipline for violation of Section
468.1295(1)(m), Florida Statutes, through a violation of section 468.1225(1)(a) and (b), Florida
Statutes, by failing to follow the minimum procedures required when fitting and selling a hearing
aid.
WHEREFORE, the Petitioner respectfully requests the Board of Speech Language Pathology
and Audiology to enter an Order imposing one or more of the following penalties: revocation or
suspension of license; imposition of an administrative fine; issuance of a reprimand; placement of
the Respondent on probation; and/or any other relief that the Board deems appropriate.
