Respondent was certified by the Criminal Justice Standards and Training Commission on July 6, 2000, and was issued Correctional Certificate Number 192163. 2. Gardner, did then engage in an act or acts which constituted sexual harassment invelving physical contact ox misuse of position against Sabrina Deam by leaning against her and/or touching her neck and/or putting his finger in her back belt loop and such activity created an intimidating, hostile, or offensive work environment for the victim. Gardner, did then engage in an act or acts which constituted. sexual harasement involving physical contact or misuse of position againat Donna Marie Lecurto by hugging her and ‘such activity created an intimidating, hostile, or offensive work environment for the victim. (a) On or between March 28, 2006 and June 26, 2006, the Respondent, Maurice D. Gardner, did then engage in an act or acts which constituted sexual, harassment involving physical contact or misuse of position against Kristie M. Lake by purposely bumping and/or brushing against her and such activity created an intimidating, hostile, ox offensive work environment for the victim. .(a@) On or between March 28, 2006 and June 26, 2006, the Respondent, Maurice D. Gardner, dia then engage in an act or acts ‘which constituted sexual harassment involving physical contact or misuse of position against Dina Mitrani by hugging and/or kissing and/or touching her buttecks and/or touched her breasts and such activity created an intimidating, hostile, or offensive work anvironmant for tha victim. (e) On or between March 28, 2006 and June 26, 2006, the respondent, Maurice D. Gardner, did fail to comply with a lawful order and/or condition of probation of the Criminal ‘Justice Standards ahd Tradning Commigsion filed on Nevember 29, 2004, by violating Chapter 118, Florida Adtiinistrative Code. The actions of the Respondent did violate the provisions of Section 943.1385(6) and/or (7), Florida Statutes, and/or ‘Rule 11iB- 27.0011(4)c, Florida Administrative Code, in that Respondent has failed to maintain the qualifications established in Section 943.13(7), Florida Statutes, which require that a Correctional officer in the State of Florida have good moral character, and/or Rule 11B-27.005(3), Florida Administrative Code, in that Respondent has failed to comply with a lawful order’ of the Commission previously entered in a disciplinary preceeding. 4, This Adwinistrative Complaint is issued pursuant to Seetion 120.60, Florida Statutes, and Rule 118-27.004(4), Florida Administrative Coda. Any proceedings concerning this Complaint shall be conducted pursuant to Chapter 120, Florida Statutes, Rulas 118-27, 28-106, and 28-107, Florida Administrative Code. Mediation is not available under Section 120.573, Florida Statutes. WHEREFORE, it is alleged that the Respondent, Maurice 0D. Gardner is guilty of violating Section 943.13(7), Florida Statutes, and/or Rule 1IB- 27.0011(4)¢, Florida Administrative Code, and/ox Rule 11B-27,005(3), Florida Administrative Code.
