CASE NO. 2011-02425 ANA MARIA WIGGINGTON, P.X.A,, RESPONDENT. | tt ADMINISTRATIVE COMPLAINT COMES NOW, Petitioner, Department of Health, by and through its undersigned counsel, and files this Administrative Complaint before the Board of Podiatric Medicine against Respondent, Ana Maria Wiggington, P.X.A., and in support thereof alleges: 1. Petitioner is the state agency charged with regulating the practice of podiatric medicine pursuant to Section 20.43, Florida Statutes, Chapter 456, Florida Statutes; and Chapter 461, Florida Statutes. 2. At all times material to this Administrative Complaint, Respondent was a certified podiatric x-ray assistant within the state of Florida, having been issued license number PXA 508. 3. Respondent’s address of record is 9103 Stonehenge Trial, Tallahassee, FL 32312. Filed June 28, 2012 3:03 PM Division of Administrative Hearings 4. Respondent was required to complete the eight hours course set forth in Section 461.0135, Florida Statutes, prior to renewal. of certification for the biennium of April 1, 2008, through March 31, 2010. 5, Respondent failed to complete the eight hours course set forth in Section 461.0135, Florida Statutes, prior to renewal of certification for the biennium of April 1, 2008, through March 31, 2010. 6. Section 461.013(1\(cc), Florida Statutes (2009), provides that violating any provision of this chapter or chapter 456, or any rules adopted pursuant thereto, constitutes grounds for disciplinary action. 7. Rule 64B18-17.001(8), Florida Administrative Code, provides that each certified podiatric x-ray assistants must complete the eight hours course set forth in Section 461.0135, Florida Statutes, prior to renewal of certification. 8. Respondent violated a provision of chapter 461 or chapter 456, or any rules adopted pursuant thereto by violating Rule 64B18-17.001(8), Florida Administrative Code, by failing to complete the eight hours course set forth in Section 461.0135, Florida Statutes, prior to renewal of certification for the biennium of April 1, 2008, through March 31, 2010. 9. Based on the foregoing, Respondent violated Section 461.013(1)(cc), Florida Statutes (2009), violating any provision of this chapter or chapter 456, or any rules adopted pursuant thereto, by violating Rule 64B18-17.001(8), Florida Department of Health v. WHEREFORE, the Petitioner respectfully requests that the Board of Podiatric Medicine enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent’s license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of the Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate.
