STATE OF FLORIDA DEPARTMENT OF HEALTH DEPARTMENT OF HEALTH, PETITIONER, v. CASE NO. 2018-07226 CHENAE LYNDEAL BAKER, C.N.A., RESPONDENT. / ADMINISTRATIVE COMPLAINT Petitioner Department of Health files this Administrative Complaint before the Board of Nursing against Respondent, Chenae Lyndeal Baker, C.N.A., and in support thereof alleges: 1. Petitioner is the state agency charged with regulating the practice of nursing assistance pursuant to Chapter 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 464, Florida Statutes. 2. At all times material to this Complaint, Respondent was certified to practice as a nursing assistant within the State of Florida, having been issued certification number CNA 18473. 3. Respondent's address of record is 714 Camrose Drive, Brandon, Florida 33510. 4, At all times material to this Complaint, Respondent provided home health care services to Patient J.B., an elderly disabled female. 5, Between about April 8, 2017, and June 15, 2017, Respondent used her position as a nursing assistant to steal approximately 15 of patient J.B.'s personal checks and withdraw approximately $6,750.00 from Patient J.B.’s checking account without patient J.B.’s knowledge or consent. 6. Between about June 11, 2017, and October 21, 2017, Respondent used her position as a nursing assistant to fraudulently obtain a minimum of $1,969.34 from Patient J.B, by using Patient J.B.’s credit card to make unauthorized purchases at a business Respondent owned using a Square? device. 7. Between about April 8, 2017, and October 21, 2017, Respondent stole a total of at least $8,719.34 from Patient J.B. COUNT I 8. Petitioner realleges and incorporates paragraphs one through seven as if fully set forth herein. 9. Section 464.204(1)(b), Florida Statutes (2016-2017), subjects a certified nursing assistant to discipline for intentionally violating any ' A square device is a small magnetic strip reader that works in conjunction with a point of sale application to allow a merchant to accept credit: card payments on a smartphone or tablet. Section 456.072(1)(m), Florida Statutes (2016-2017), subjects a certified nursing assistant to discipline for making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice of a profession. 11. _ Respondent intentionally made deceptive, untrue, or fraudulent representations in or related to the practice of a profession and/or employed a trick or scheme in or related to the practice of a profession in one or more of the following ways: a, By using her position as a certified nursing assistant to fraudulently obtain a minimum of $6,750.00 in personal checks from an elderly and disabled patient; b. By using her position as a certified nursing assistant to fraudulently obtain a minimum of $1,969.34 from an elderly disabled patient by making unauthorized purchases at a business she owned; and/or c. By using her position as a certified nursing assistant to steal a total of at least $8,719.34 from an elderly and disabled patient. DOH v. Based on the foregoing, Respondent violated Section 464.204(1)(b), Florida Statutes (2016-2017), by intentionally violating Section 456.072(1)(m), Florida Statutes (2016-2017). COUNT II 13. Petitioner realleges and incorporates paragraphs one through seven as if fully set forth herein. 14. Section 464.204(1)(b), Florida Statutes (2016-2017), subjects a certified nursing assistant to discipline for intentionally violating any provision of Chapter 464, 456, or the rules adopted by the Board of Nursing. 15. Section 464.018(1)(h), Florida Statutes (2016-2017), subjects a certified nursing assistant to discipline for engaging in unprofessional conduct, as defined by Board rule. 16. Rule 64B9-8.005(4), Florida Administrative Code, defines unprofessional conduct to include stealing from a patient. 17. Respondent intentionally engaged in unprofessional conduct by stealing a minimum of $8,719.34 from Patient J.B. 18. Based on the foregoing, Respondent violated Section ~ 464.204(1)(b), Florida Statutes (2016-2017), by intentionally violating Section 464.018(1)(h), Florida Statutes (2016-2017), by engaging in DOH v. Chenae Lyndeal Baker, C.N.A. 4 DOH Case Number 2018-07226 unprofessional conduct as defined by Rule 64B9-8.005(4), Florida Administrative Code. WHEREFORE, Petitioner respectfully requests that the Board of Nursing enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent's license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate. A request or petition for an administrative hearing must be in writing and must be received by the Department within 21 days from the day Respondent received the Administrative Complaint, pursuant to Rule 28-106,.111(2), Florida Administrative Code. If Respondent fails to request a hearing within 21 days of receipt of this Administrative Complaint, Respondent waives the right to request a hearing on the facts alleged in this Administrative Complaint pursuant to Rule 28-106.111(4), Florida Administrative Code. Any request for an administrative proceeding to challenge or contest the material facts or charges contained in the Administrative Complaint must conform to Rule 28-106.2015(5), Florida Administrative Code. Mediation Pursuant to Section 120.573, Florida Statutes, is not available to resolve this administrative complaint. NOTICE REGARDING ASSESSMENT OF COSTS Respondent is placed on notice that Petitioner has incurred costs related to the investigation and prosecution of this matter. Pursuant to Section 456.072(4), Florida Statutes, the Board shall assess costs related to the investigation and prosecution of a disciplinary matter, which may include attorney hours and costs, on the Respondent in addition to any other discipline imposed.
