STIPULATION AND ORDER TO EXTEND MOTION FOR SUMMARY JUDGEMENT OPPOSITION AND REPLY DATE
WILLIAM H. ORRICK, District Judge.
Pursuant to Local Rule 6-2, the parties to the above entitled action, by and through their respective counsel of record, hereby stipulate as follows:
WHEREAS, Plaintiffs filed their Fourth Amended Complaint on September 1, 2016 (Dkt. No. 83);
WHEREAS, the Parties have completed fact discovery;
WHEREAS, Defendant filed a Motion for Summary Judgment ("MSJ") on February 7, 2018 (Dkt. No. 114);
WHEREAS, Plaintiff's response to Defendant's MSJ is due on February 21, 2018;
WHEREAS, Defendant's Reply is due on February 28, 2018;
WHEREAS, the hearing on Defendant's MSJ is scheduled for March 28, 2018;
WHEREAS, to accommodate Plaintiff's counsel's and Defendant's counsel's work and upcoming vacation schedules, the Parties have agreed to amend the due dates for Plaintiff's response and Defendant's reply as follows:
• Plaintiff's response due date extended from February 21, 2018 to February 28, 2018
• Defendant's reply due date extended from February, 28, 2018 to March 21, 2018;
WHEREAS, the proposed new dates would not affect any other deadlines set by this Court.
IT IS HEREBY STIPULATED between Plaintiffs and Defendant, by and through their undersigned attorneys, that Plaintiff's response to Defendant's MSJ is due on February 28, 2018 and Defendant's reply is due on March 21, 2018.
