STIPULATION OF DISMISSAL AND [PROPOSED] ORDER
SAMUEL CONTI, District Judge.
WHEREAS, Plaintiff ANN CALLEJA, individually and in her capacity as surviving spouse and personal representative of the estate of her husband, Joseph Calleja, and Defendant U.S. FINANCIAL LIFE INSURANCE COMPANY, erroneously sued and served as U.S. FINANCIAL INSURANCE COMPANY, an AXA FINANCIAL COMPANY, settled this matter on or about June 23, 2014;
WHEREAS Defendant CIGI DIRECT INSURANCE SERVICES was previously dismissed by the Court on March 10, 2014;
THEREFORE, IT IS HEREBY STIPULATED by and between Plaintiff and U.S. FINANCIAL LIFE INSURANCE COMPANY through their designated counsel that the above-captioned action should be dismissed with prejudice pursuant to FRCP 41(a)(1)(A). The parties further stipulate that the parties shall bear their own attorney's fees, expenses and costs.
IT IS SO STIPULATED.
