MOTION TO CONTINUE REVOCATION HEARING

Comes now Joshua Huff, by and through Assistant Federal Public Defender Jessica L. Milburn, and requests that the Court continue his hearing on revocation of supervised release. In support of his motion, he states the following:

1. Mr. Huff has been seeking placement at a treatment center recommended by his treatment team at Veterans Affairs. The recommended course of treatment is for Mr. Huff to enter programming at the ARCH in Omaha, NE. 2. Mr. Huff's probation officer opposes any plan for release. 3. Mr. Huff has not yet been screened at the ARCH and counsel would like the opportunity to see if Mr. Huff can be accepted into the program. Thereafter, counsel would like to bring the matter of release before the Magistrate before disposition of the petition in this case. 4. While USPO Megan Davis is opposed to release, the Court may make a determination that placement at the ARCH is a plan which will assure the defendant's appearance at court and safety of the community. 5. Mr. Huff is requesting that this Court delay his revocation proceedings for two weeks, so counsel can complete investigation into whether he can be accepted into the program at the ARCH.

Wherefore, Mr. Huff requests that the Court enter an Order continuing his revocation hearing for two weeks for the above stated reasons.
