ORDER AND JUDGMENT*

PER CURIAM.

Petitioner George E. Carter was convicted of criminal violation of the District of Columbia Code1 and was subsequently transferred to the United States Penitentiary, Leavenworth, Kansas, to serve his sentence. The district court denied his Petition for Writ of Habeas Corpus, filed pursuant to 28 U.S.C. § 2241. Carter v. Thornburgh, No. 90-3486-R (D.Kan. Aug. 23, 1991). Petitioner appeals pursuant to 28 U.S.C. § 2253.2

In response to Petitioner's Notice of Appeal, the district court found that the appeal was frivolous and not taken in good faith. Based on this finding, the court denied Petitioner leave to proceed in forma pauperis on appeal. Dist.Ct.R. doc. 23. However, Petitioner's motion for in forma pauperis status on appeal is hereby granted. Case No. 90-3340, an interlocutory appeal and Petition for Writ of Mandamus, is dismissed for mootness because of the court's disposition of Petitioner's appeal on the merits herein.

Each of the claims Petitioner raises on appeal has been considered and was found to be lacking in merit in Blango v. Thornburgh, 942 F.2d 1487 (10th Cir.1991). The judgment of the United States District Court for the District of Kansas is AFFIRMED. The mandate shall issue forthwith.

Petitioner notes that at sentencing, the District of Columbia Superior Court consolidated its sentence for violation of the District of Columbia Code with that of the United States District Court for the Eastern District of Virginia for a related violation of the United States Code. Petitioner's sentencing by the United States District Court has no impact on the his claim that he was unconstitutionally transferred from the District of Columbia Department of Corrections facility to the United States Penitentiary, Leavenworth, Kansas
