AGENCY FOR HEALTH ier i BM APR3O Po EOI bes s FLORIDA LEAGUE OF CITIES, ISTRATIVE HEARINGS ° Petitioner, Formerly DOAH CASE NO. 02-1579 AHCA CASE NO. 2008004163 vs. DETERMINATION NO. 20011121-008 DEPARTMENT OF LABOR AND EMPLOYMENT SECURITY, DIVISION OF WORKER’S COMPENSATION, BUREAU OF REHABILITATION AND MEDICAL SERVICES’, Respondent. / FINAL ORDER THIS CAUSE concerns a Petition to the Division of Workers’ Compensation in Response to Determination from the Bureau of Rehabilitation and Medical Services and Request for Hearing (“Petition’’) that the Petitioner filed on February 15, 2002. On April 18, 2002, the Petition was forwarded to the Division of Administrative Hearings by the Agency and assigned to an Administrative Law Judge (“ALJ”). On June 24, 2002, the parties filed a Joint Motion to Relinquish Jurisdiction, stating that the parties had amicably resolved the dispute. On June 25, 2002, the ALJ assigned to the case entered an Order Closing File, relinquishing jurisdiction back to the Agency. ' This case commenced prior to the Legislature’s decision to place the Agency for Health Care Administration in charge of Workers’ Compensation dispute resolution proceedings under Chapter 440, Florida Statutes. On April 2, 2008, the Agency for Health Care Administration issued an Order to Show Cause, asking the parties to show cause why a final order should not be entered in this matter since there had been no activity since June of 2002. There has been no response to the Order to Show Cause. Based upon the foregoing, IT IS THEREFORE ORDERED AND ADJUDGED THAT: The Petitioner’s Petition is dismissed with prejudice since the Petitioner by its inaction has abandoned this matter. Unless it has already done so, Petitioner shall submit the correct reimbursement amount as stated in the Agency’s January 18, 2002, Determination to William P. McLeod, M.D. within 30 days of the date that this final order is rendered, and shall submit proof of reimbursement to: Anna Ohlson, R.N., AHCA WC Med Services, Division of Worker’s Compensation, 200 East Gaines Street, Tallahassee, Florida 32399-4229.
