("Petitioner"), files this Administrative Complaint before the Construction Industry Licensing Board, against DONALD L. CORBETT, JR., ("Respondent"), and Says: | ‘1 . Petitioner is the state agency charged with regulating the practice of contracting pursuant to Section 20.165, Florida Statutes, and Chapters 455 and.489, Florida Statutes, . 2. Respondent is, and has been at all times material hereto, a Certified General Contractor in the State of Florida, having been issued license number CG C016983, 3. Respondent's last known addresses are: 4282 Southwest Oakhaven Lane, Palm . City, Florida, 34990 and Post Office Box 639, Toccoa, Georgia, 30577, 4. At all times material hereto, Respondent was licensed as qualifying agent for STN “81/17/2082 _ 89:57 8509221276 DBPR GENERAL CUUNS#! rren us Don Corbett, Inc. , 5. Section 489.1195(a), Florida Statutes, provides thet all primary qualifying agents for a business organization ate jointly and equally responsible for supervision of all operations of the business organization; for all field work at al! sites; and for financial matters, both for the organization in general and for each specific job. 6. On or about November 10, 2000, the City of Port St, Lucie, Florida, Contractors’ Bxamining Board suspended Respondent’s permitting privileges for one year for proceeding on a job at 2081 Southeast Allamanda Drive, Port St, Lucie, Florida, without obtaining the applicable Building Department inspections. 7. Respondent proceeded on the project without the required tie beam inspection. COUNT I 8, Petitioner realleges and incorporates the allegations set forth in paragraphs ono through seven as though fully set forth herein. 9. Based on the foregoing, the Respondent violated Section 489.129(1)(0), Florida Statutes (1999), by proceeding on any job without obtaining the applicable local building department permits and inspections, COUNT If 10. _— Petitioner realleges and incorporates the allegations set forth in paragraphs one through seven as though fully set forth herein, 11. Based on the foregoing’ the Respondent violated Section 489.129(1}(m), Florida Statutes (1999), by committing incompetency or misconduct in the practice of contracting. *@1/17/2882 a3:57 8509221278 DBPR GENERAL COUNSEL rea oS a 4 WHEREFORE, Petitioner respectfully requests the Construction Industry Licensing Board enter an Order imposing one or more of the following penalties: place on probation, reprimand the licensee, revoke, suspend, deny the issuance or rertewal of the cartificate or registration, require financial restitution to a consumer, impose an administrative fine not to exceed $5,000 per violation, require continuing education, assess costs associated with investigation and prosecution, impose any or all penalties delineated within Section 455,227(2), Florida Statutes, and/or any other relief that the Board is authorized to impose pursuant to Chapters 489, 455, Florida Statutes, and/or the rules promulgated thereunder.
