On or about October 7, 2003, Petitioner’s Investigator was investigating a complaint and interviewed Respondent during the course of Petitioner’s Investigation. 5. On or about October 7, 2003, Respondent informed Petitioner’s investigator that Respondent did not know Steven Slepian. 6. Respondent knew Steven Slepian before October 7, 2003, and assisted Steven Slepian in filing a complaint against a real estate licensee. COUNT I Based upon the foregoing, Respondent is guilty of making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice of a profession in violation of Section 455.227(1)(m), Florida Statutes. . COUNT I Based upon the foregoing, Respondent is guilty of having obstructed or hindered in any manner the enforcement of Chapter 475, Florida Statutes or the performance of any lawful duty by any person acting under the authority of Chapter 475, Florida Statutes in violation of Section 475 -42(1)(i), Florida Statutes and, therefore, in violation of Section 475.25( 1)(e), Florida Statutes, WHEREFORE, Petitioner respectfully requests the Florida Real Estate Commission, or the Department of Business and Professional Regulation, as may be appropriate, to issue a Final Order as final agency action finding the Respondent(s) guilty as charged.
