On August 30, 2018, the undersigned granted Defendant, Brian Eagle's (Eagle) Motion for a Psychiatric Exam in open court, (Doc. 48). On October 29, 2018, the Court received notice from Bret Dorethy, Acting Warden at Metropolitan Detention Center, Los Angeles, California, where Eagle is being evaluated, requesting a 15-day extension of the evaluation.

Accordingly, IT IS ORDERED that a 15-day extension of the evaluation of Eagle is GRANTED. The study period will begin on November 5, 2018 and the final report submitted to the Court no later than November 26, 2018.

Dear Judge Johnston:

This is in response to your court order dated August 30, 2018, which committed Mr. Eagle for an examination pursuant to 18 U.S.C. § 4241. Mr. Eagle was designated to our facility on September 12, 2018. He arrived to the Metropolitan Detention Center (MDC), Los Angeles, CA, on September 20, 2018.

Pursuant to 18 U.S.C. § 4241, the defendant may be committed for a period of up to 30 days so that Psychology staff can complete an evaluation. Our clinical psychologist requests a 15-day extension as permitted by the statute to complete the testing and examination necessary to develop a history, diagnosis, and opinion. We would also ask the Court to determine that commitment for the evaluation commence upon his arrival to our facility. It is anticipated that the evaluation will be completed by November 5, 2018. The report will be submitted to the Court within three weeks of completion of the evaluation. You can expect to receive the report by November 26, 2018, should you grant our request for an extension.
