JOINT MOTION TO EXTEND PROGRESSION ORDER

Plaintiff, Thomas Harris, and Defendants, Sapp Bros, Inc. and Sapp Bros. Petroleum, Inc., by and through their attorneys, hereby move this Court for an extension of the progression order in this case. In support of this motion, the parties state as follows:

1. Trial in this matter is currently scheduled for July 8, 2019, with the pre-trial conference scheduled for June 24, 2019.

2. On February 11, 2019, Defendants filed their Motion for Summary Judgment. The parties are still in the process of briefing this motion. Defendants believe that summary judgment will significantly narrow the issues in this matter or dispose of the matter entirely.

3. In addition, the undersigned attorney for Defendants will be on maternity leave from April through June 2019.

4. Accordingly, the parties request that the remaining deadlines be extended as follows:

a. Disclosure of Nonexpert Witnesses on or before December 6, 2019. b. Disclosure of Trial Exhibits on or before December 6, 2019. c. Motions in Limine shall be filed on or before December 20, 2019.

8. The trial is to be continued to February 10, 2020 and a pre-trial conference shall be set at the convenience of the Court based upon the new trial date.

WHEREFORE, the parties respectfully request that the Court amend the Final Schedule for Progression of Case as set forth herein and, if necessary, schedule a conference call with the parties to assist in implementing the order progressing the case as requested herein.
