Construction Lien

I had a lien filed against my home by a proffesional con man. I in turn filed a Contest of Lien that specifically stated the lienor had 60 days to sue. His attorney filed a suit on the 62 day and has now caused me a great financial burden because I cannot close a loan. I do not want to sue the lienor because he is a pro and will just file for bankruptcy. Can I sue the attorney that filed the suit ?
