I have a question concerning New Jersey The Consumer Fraud Act & Home Improvement Practice.

I understand that a builder that BUILDS your house is not governed by this Act.

I understand that a Home Improvement Company is governed by this Act.

I recently had a manufactured house BUILT in Virginia and I then had a "BUILDER" as the general contractor arrange to have the finishing work (toilets, sinks, countertops, etc.) installed.

Would my General Contractor "BUILDER" have to adhere to the Consumer Fraud Act & Home Improvement Practice?

Tricky question, and it probably depends on what is in the contract. Did you own the property already? Is it on a foundation/basement that X built, not BUILDER? Were there already utilities to the foundation? What permits were needed, how were they filled out, and who took them out? Did you need an architect? If so, who contracted with him?

Can't get your answer in this forum, it's just not suited for this. You need to get a consult with an attorney that KNOWS construction, as this is too nuanced to just go to an atty that does some construction contracts each year. Good luck. - KJB
