intimidation

i recently completed 2 months of leave to attend a rehab center due to an eating disorder. Upon my return, my employer stated that they do not think its in my best interest, nor the firms best interest if i return to the firm. They have offered me a severance pkg with a termination agreement. Do I have any recourse?

Retaliation for exercising your legal right to Family Medical Leave is illegal. That being said, if you think it's in your best interests to move on, you need to negotiate the best possible severance package.

My practice is primarily devoted to negotiating severance packages in situations such as these. In my experience, people who try to negotiate their own severance packages tend to ask for too little (if anything) above what is being offered and often leave out significant benefits out of the agreement.
