misrepresented property

if you are renting an apartment from someone and they sell you sofa and then you later find that the sofa is hazardous (ie you find a used condom in the sofa). are you legally bound to honor the check that you wrote even if you offer for them to have the sofa back???

In your case, I would agree that the sofa that they sold you is "defective" and you should return the item and get your money back. That is unless, the person stated that you are buying it "as is".
