Person's Right to Work Freedom
Scenario: Person A wants to work for person B, and applies to that company without any solitication by person B using pubically available information to apply, but Person B has a ''non compete'' with Person A's company that includes a will not solicit or hire.
Question: Is Person A's freedom to work wherever he/she wants infringed upon by Person B's non compete?

Person A's freedom to work for B is absolutely infringed upon by B's non-compete. However, that infringement is perfectly lawful. There is no such thing as a 'right' to work where you want to. Employers frequently have restrictions. It is certainly an unfortunate situation for Person A, but there's nothing A can do about it.
