relocating with my children

I am wanting to move from Alaska to Arizona with my three kids.I am recently divorced and have asked my ex husband to write me a letter saying it was ok for me to drive through Canada with them. He refuses to sign a paper for me unless i take him off of child support and allow him to pay me less and directly to me. I am the custodial parent having shared legal custody with him. We have also agreed in the divorce order that if either one of us was to move away that we would split the cost of airfare for the kids to visit. Will i get in trouble if i take the children out of state ,and the country ?

Re: relocating with my children

You KNOW you will, b/c your ex has already made it clear that he will raise a stink (as well he should, if he cares about his kids).

Here's the thing: if you want to leave the country with your kids, then you have to decide that you will compromise with your ex. Get a court order, don't rely on him signing a piece of paper.

IF, however, the court order does not specifically forbid you moving out of state/country, then there's nothing to negotiate.

Take the current court order to a local attorney familiar with the family court judges and simply ask whether this order forbids you leaving or not and what do you have to do to get a valid order in case it does.
