Re:Public Retirement System

Is their any case laws regarding types of exparty communications between a retirement system and the medical contract provider? On numerous occasions our employees have complained about our retirement system staff requesting contract doctors to change their position when it did not suit the staffs intent to deny disability retirements.

Maybe most are denied, but a substantial number are not, and the difference may depend upon the skill and savvy of the applicant, where the application is being made (employer, SSA, etc.) and whether the claim is permanent or temporary disability.

There is undoubtedly a medium to large amount of case law, but the usefulness of the appellate cases to a particular litigant or claimant would depend upon closeness of factual fit, and therefore no LawGuru attorney would be able to give you a handy-dandy list of citable cases to support your position without a very detailed interview with you.
