i would like to know which steps can i take to file and send a separation agreement to my spouse. no children involved

Both you and your spouse must sign for there to be a separation agreement. This means that first you must discuss the separation with your spouse and come to an understanding on how you are to separate the property and debt. The terms of the understanding must be set forth on paper which is signed by both parties and acknowledged by a notary public. The separation agreement must be filed with the County Clerk. After a year living under the separation agreement, you would have grounds to commence an action for a divorce.
