Texas DWI
I was given a dwi (3rd) when pd were summoned to small accident where I hit a lady from behind. I was not drunk but the officer smelled beer on me. Can I be given a DWI when he arrived at the accident scene 45 later? He didn't see me driving while drunk.. Should I fight this in trial? I was given field tests which they said I failed. I refused the breath test.

Since this is your 3rd DWI -- if you don't fight it, you are probably looking at significant jail time. Get a lawyer.
