will

My aunt is dying. She has no will. I am her power of attorney to handle all her finances. I am on all her accounts. She has no property. Her funeral is all paid for. Does this need to go to probate after she dies?

Re: will

It depends. If you are joint owner of her accounts, then they transfer to you upon her death without probate. If the accounts are in her name and you have signature authority only, that authority could die when she does.

It would be a good idea to gather all your paperwork and do a face to face consult with a lawyer. It always seems that some asset that can't be transferred without probate tends to show up by surprise after the death.
