I received a judgment of foreclosure and sale against me. The courts have stayed foreclosure auctions in New York due to Coronavirus. Today, the lender published the judgment of foreclosure and sale itself in the newspaper designated in the judgment for publishing the auction date and time. It is not a notice of auction, but a reprinting of the judgment of foreclosure and sale word for word.
What would be the purpose of them doing this? And was it allowed by law, as the judgment only specifies that they publish the auction date and time in the proposed news paper?
Answer to q #1: One reason is because there are a plethora of real estate investors, brokers and potential buyers out there who will see the publication and maybe become interested in purchasing the house when the stay is lifted and it goes to auction. And eventually it will.
Answer to q #2: Yes, allowed by law. Judgments are public documents for all to see.
Advice: Use this time wisely and do 2 things: 1) find yourself another place to live. Unfortunately, the court battle is over and you've lost. 2) consult with a bankruptcy attorney who may or may not be able to buy you even more time. Good luck.
