Hi,
I have applied for my H1B extension in August 2019. My 240 days working period on H1B receipt number is expiring on May 4th. My case was initially in Nebraska, later it was transferred to another processing center in December 2019, no updates after that. I tried pushing the case to premium this week but unfortunately, USCIS has suspended premium processing due to coronavirus outbreak. Based on the current processing times and COVID-19 chaos, I don't think I would be hearing back from USCIS for at least 2 months. What are my options now? Would I be out of status after my 240 days? My attorney says that USCIS would possibly provide additional extension as this is an unprecedented unforeseen event and there is nothing in their hands.
Please advice.
Thank you,
Suman
Yes, it is very possible that the USCIS will change the rules in your favor soon.
I agree with your attorney and Mr. Behar ... something is bound to be done by CIS.
NOTE, you won't be out-of status after 240 days ... you just won't be allowed to work.
Your attorney is right in this unprecedented situation.
