I filed bankruptcy chapter 7 last year now the trustee is not giving me my refund that was sent to him almost 20 days ago and my lawyer is not helping what should I do
There is no time limit proscribed by law.
Juan is correct. 20 days is not very long time given the current conditions. Many offices are working with reduced staffs. Perhaps your attorney is also running with a reduced staff. Just because the refund was sent to the trustee does not mean that he/she has received it. I can tell you that there have been many many times that the IRS has claimed to have processed a return and issued a refund and still weeks passed before the $$ was seen by human eyes. There are real issues about what portion of the refund the trustee may claim and what amount is to be refunded to you. Rely on your attorney to assist you with this. You have already paid the fee, and are entitled to service. You might tactfully press the attorney for a plan to follow up. When and how will they follow up to determine that the funds did arrive and that the trustee is proceeding with reasonable speed. Ask the attorney to get written confirmation for all steps in the process. Good luck.
Since you are represented by counsel, all your questions need to be directed to your attorney.
20 days is not a long time. Especially with current Coronavirus issues likely keeping them from their office from even getting the mail in and out. When you hit 60 days you might follow up with a phone call.
Non-Paying Customer
I own a dog and pet boarding kennels, and have a customer who has left their dog with us for almost 90 days without paying.
(well they did pay once $46 on a $600 bill SO FAR)
The bottom line is that they still owe us over $600 by now and the bill grows daily because they still have not picked up he dog! We have spoken to them on the phone several times, and they claim to still want their dog, and keep promising to come in and pay something, and yet, orther than the meger $46 dollars they havce paid, they have yet to either show up when promising too, nor have they paid an additional dime towards their bill!
What are my legal recourses for collection, filing some kind of a lean, or small claims court, which I don't want to hassel with?
quick-claim trust
Without telling me or my sister, my brother convinced my mother (85) to sign a quick-claim deed for her home and property. He claims the house will be placed in ''trust'' to protect an inheritance split equally 4-ways. Yet he won't allow me to read the contract he wants me to sign. (The contract was drawn up by his financial advisor, not an attorney.) What should or can I do?
Evidence
Immediate family member committed suicide, when police came they took the weapon used and my phone which was on the floor that I used to call 911. We have been trying to retrieve the items or 'evidence' but the police department has been giving us the run around. What can we do? Is there a specific form we need? Or should we try to find a lawyer for this? Are there any laws against this? Thank You
