Hypothetically speaking, it would be the criminal case if Alice pocketed the money and never put it into the business at all or if there’s is any type of demonstrable fraud on Alice’s part. It could be a civil case if any of the above is present or if Alice did not invest the money prudently as a reasonable man would have invested.

i got your reply, and thanks for the info and what i did say was i asked her to lend me the phone and i used it for about 3 months BUT i paid for those 3 months i paid with money orders and gave them to her. then i asked her to cancel the phone, she never did so what do i say in court?
