If I deny workman’s comp, will my test results still be sent to my employer?

I agree with the other posters, there are too many variables. You should sit down and talk to an attorney. You need to describe the whole circumstances. It may be that the WC claim is you most valuable claim. Good luck.

Attorney Chaban is absolutely right. And the ADA does not apply to Current users. Nor do they have to pay unemployment compensation for failing a drug test in most cases.
Your only hope is that it was for a prescription medication, or a false positive. I would be retested immediately at a place that does that. Check locally. Google it. Your doctor should know, or Legal Aid would know, or the public defenders office would know.
If you know what you had in you and it was illegal, then probably no point in doing the above.

This is a question for an employment attorney.

Once the testing is done at the behest of your employer, it is entitled to received the results. Since you fainted at work, then it can be treated as work-related by the employer requiring the test. It all depend on what the work rules of your place of employment are. I am presuming there is a testing requirement when something happens at work, which will give the employer access to the result.
