If I initially signed onto a lease for a business (which I am not a partner of, but they needed more names since they were a new business) in February 2002 and the property was sold, the new owner had the three business partners sign a new contract with her. I did not sign that. From what I understand it was for five years and they left prior to lease end with eight months left. They went to court and it was ruled since it was mutual no money was due (I was not named on that lawsuit). The landlord appealed and I just foumd out through garnishment and some going back and forth with the partners that my name was on the second lawsuit. I am now finding out as well that the partnership included my name with their lawyer to be represented (which I did not know or agree to). Now they are trying to settle and want to include my assets. I don't feel as I owe the landlord that purchased the property and I should have never been named in the second lawsuit so I refuse to give anyone my informaton and want my money back. I am on unemployment now. I am thinking of getting my own lawyer. I have good credit and (had) no public court records and want to keep it that way. Is there anything that I can do? I am absolutely frustrasted with everyone involved.
Look at the cost of settlement and if it is less, pay it. If not, you certainly have a right to hire your own attorney if you were personally sued. Tim Klisz kliszlaw.com
