I’m not a lawyer, I feel my family is being taken advantage of , and I have no where to turn. My wife was arrested for a dwi. When she was pulled over the officer noticed she has a PBA card and asked her about it. She told him it was an old card , it was her ex brother in law , who hates her for divorcing his brother. The police officer then made her call her ex brother in law. His family has been out to get my wife since the divorce. When her ex brother in law spoke to the officer he told him to arrest her. We told the lawyer the story and he said he will look into it. Court is for tomorrow and we found out our lawyer is friends with the arresting officer. He said the officer did nothing wrong by contacting the brother in law before he ran her license. But I’ve heard from police officers that this officer should be in big trouble for what he has done. Is this true and is there anything that can be done ?
Police Officers can call the officer who is listed on the PBA card. So I do not see anything wrong with the officer who stopped your wife with calling the brother in law.
Next, it cannot be said whether or not the lawyer is representing the other side just because he is friends with the police. That is a loaded question that is impossible to answer. The lawyer is representing your wife. However, if you do not trust him then you should find a lawyer whom you trust. Not having faith in your own lawyer is a good reason to find someone else.
