My fiance is paying child support on a child he believes is not his. He is now in the work release program for non-support of a dependent. The mother of this child signed his name on a paternity affidavid and the birth certific. That is how they are getting him for child support. He wrote the judge requesting a test and was denied. All of this is out of Whitley Co (Columbia City, IN) He lives in Allen Co (Fort Wayne, IN). How can we petition the courts here for a paternity test? The only way this woman will bring the child in for a test is if it is court ordered. I just don't want him paying child support on a child that might not be his. Plus he has two other children that he pays child support on and the money that is going to this woman for the child that might not be his could go towards his other two children. Someone help! I need to know who he needs to talk to about filing a petition here in Allen Co for the test.

Setting aside paternity is a complicated legal process, especially if she forged his name on a paternity affidavit. He really needs to hire counsel.
