So, what happens if the doctor discharges you with permanent limitations i.e. no lifting more than 20lbs above the waist, no pulling twisting or gripping? Do you have to go find a job that allows these restrictions? When in reality you know no employer is going to hire a person with all these limitations. Do you continue on Workers Comp or do you then apply for unemployment because your employer laid you off when you were put on these limitations?

Your employer has to offer you a modified duty type of work. If they can't accommodate you then you need to be receiving temporary disability benefits up to 104 weeks. You need to request for an evaluation by a QME/AME and a rating for your disability which will get you a settlement. You need to retain an experienced worker's compensation attorney to get you the maximum settlement you are entitled to. Feel free to call us at 213.388.7070 for a free consultation.
