My 91 yr old father has dementia ( very bad). My sister who has power of atty will not have him declared incompetant because she wants to sell his house and she & my brother in law are planning on hiding the money in various safe deposit boxes. They are trying to hide the money from medicaid so mom & dad won't loose their current low income benefits. I am very afraid of what they are trying to do because i think it is criminal. My other siblings don't seem concerned about this. What should i do? Seems very much like fraud to me.

my fathers brother and sister are calling aps on me on a regular basis all charges are un founded to the totsl of 25 calls we came to a agreement in court that that behavior would not continue but the brother is acting as his sisters agent so now the court appointed fudiciary wants conservatorship of my father if my father was not wealthy none of this would have occurred and I would still be taking care of him we are in the coachella valley and this is a closet industry in this area my entire life savings was wiped out during the 2 years that the case lasted and my father has never been declared incapacitaded he in court repeatedly stated if he were conserved he would want me to be that person its being couched as protection for me I think its just his money not him hes perfectly healthy and happy I cannot afford a lawyer how do I handle this the fudiciary is applying for an emergency conservatorship first only because my father has 2 drs apt in the next 2 weeks ones that I made for him

I spent some of the proceeds of her co-op sale on myself as poa for my mother with her permission. Medicaid was going to take all of it but I moved her into a $6000 assisted living facility for 2000 because I knew someone. I was the only sibling out of 4 helping her and because I got her in there and because I helped her with everything she told me i could share the money for my rent, etc. as she knew I had no steady income I took her to Dr's and visited several times a week for 3 years. I spent approx 14k of 35k on me by writing cks to myself. She passed away in Dec and now my brother as executor is accusing me of theft. He didn't visit her for 3 years and was aware of the money situation 3years ago when it happened and did nothing. What can he do to me now? I am in NY. Thank you.

For Power of Attorney's issued in Maryland, is it required to get the document notarized as well as gather two witness signatures or is it one or the other? (i.e. Either you need two witness or either you need to have the document notarized but not both)

An elderly lady I know wants to take her 2 daughters and son's-in-law on a trip and she wants to pay for it. If she would go into a nursing home before the 5 years is up, could Medicaid ask her children to pay back the government for their portions of the trip?

My 90 year old mother lives at home and is being cared for by health sides through a geriatric care management company. My sister hired them. She is the health care proxy and she livess out of state. I live nearby and visit regularly.
One of the aides has a temper and on several occasions she has lashed out at me. Of course my mother is upset by this, and when she asks her to stop she doesn't let up. Unfortunately, my mother has short term memory issues and has no recollection of these incidences. I have told my sister about them but she doesn't believe me. Would it be legal to record these conversations?

First allow me to give some background information. Recently, my father was a resident in a nursing home. Also living in the same facility was his girlfriend whom he became involved with before they became nursing home residents. Both my father and his lady friend were considered at the same level of cognizance in the early stages of Dementia. At one point the pair had some sexual contact at the home and were discovered. The woman's family called the police and my father was convicted of sexual misconduct. He began his 6 month jail term today. We were told by the social worker at the home that we had until Monday to collect his personal things from his room and they wouldn't be touched by staff until we arrived. We arrived today to collect them only to discover they had taken it upon themselves to remove all his personal effects from his room and no one seemed to know what was done with his things. No one seemed concerned or willing to help find them at all until I began to threaten calling the police. They were then able to locate his things in a random, unlocked hall closet. We discovered valuable items such as his electronics, some cash and other items were missing. The administrator told us he didn't care and it wasn't his problem and to feel free to call the police. We called the police and they refused to help, telling us it's a civil matter. I have no idea where to go from here. Is there anything I can do about the theft of my father's valuables and the bad way the home handled the situation?

Can there be two powers of attorney for one person?
My Mom wants to grant me power of attorney and I want my brother to also have it in case something happens to me. Can he have it valid while I'm still alive or can we make it so it becomes effective only upon my death or inability?

My mother is in a nursing home for good. She has $2000 to her name. She gets to keep $30 a month of her social security and the rest goes to the nursing home. She is on medicaid. Her home is up for sale and worth maybe $35,000. She doesn't want to pay her real estate taxes or insurance on this home as it is vacant and she only has the $2000 left to her name. If she stops paying these, won't the back taxes get paid whenever the house sells? Can she be in any trouble?
