Dui question

I was cited for a DUI on MAY 10, and Then the citiation was torn up because improper procedures, But now the Base wants to take me to NJP for article 111. They only thing they have is the Desk Jounral from the the MA call into dispatch. The CHP officer stated I was under the legal limited and allow me to continue to drive the MA also Allow me to drive. I had a previous DUI in 05 but is not a treatment failure, question on what grounds would they go after in court martial for the article 111 charge if there isn't any report of the BAC that was in my system or any arrest nor citation of DUI.

Discharge

I received an Under Honorable Conditions Discharge (General) in the Air Force due to a pattern of misconduct. I had a lot of financial problems towards the end. I was young and not mature, 25 at the time of discharge. I am a changed person now with a great family and this is still haunting me and preventing me from obtaining and law enforcement or emergency careers and don't know how to fix it. I look back and I am ashamed. I was young and didn't know what I was thinking. I am now 38 years old and would like to upgrade my discharge . Any advice on what I need to do?

General (Under Honerable Conditions) upgrade

Hi, I was discharged back in 95 for financial irresponsibility and given a general discharge. It is preventing me form working in any city job. can i get this upgraded?

Deserter????

Our family went through hard times and we were homeless. My husband took leave to find us an apartment. On the 2nd day of his leave he found out that he failed his drug test and his command ordered him to report back to his ship. Instead he continued with his leave inhopes of findin his family shelter. He was gone for more than 30 days and was considered a diserter. He was picke up and held in a local jail for 5 days prior to the military coming to get him. He did indeed miss ships movement (deployment). He is now in the brig. What happens next? Can they hold him until his ship return? How long will he be punished? Also will the time served in the local jail count against the time he is going to serve? Please help. Our family is still homeless & I don't know where to turn? Will the militart help and provide temporary shelter until his sentencing is over?

Falsely accused of rape found not guilty

LawGuru, I was falsely accused of rape by a subordinate, the allegations were so unture that JAG did not pick up the case. I was refered to an Art 15 proceeding by my command, which I was found NOT GUILTY. My question is; I was titled, how do I go about removing this title? TOP

Service Members Civil Relief Act and Leases

Does the Service Members Civil Relief Act cover a service member if he / she wants to break a lease due to being offered housing on a military post?

In the lease that I use it has a military clause regarding the circumstances a lease can be broken by the tenant. One of the reasons listed is if the family is offered base housing. However, I see no where in the details of the Service Members Civil Relief Act that lists this as a reason.

Can my tenant break the lease if he gets on post housing if such a circumstance is not covered in the Service Members Civil Relief Act?

Desertion while on mid-tour leave.

A guy in my unit went on mid-tour leave and then refused to return to Afghanistan. It has been over 30 days so he is off our logs. What is the punishment that he is likely to face? What is the maximum sentence he may receive? Keep in mind he openly admitted to his family, who in turn told our commander, that he has the intent to never return to the military.

Medical Discharge

My son entered the Air Force on a HPSP medical scholarship. He is now in his second year of a surgical residency.

As a teenage my son developed panic attacks. He worked with a counselor at that time. The anxiety continued but never got to as a severe point as it is now.

He is currently seeking medical treatment, and he will be leaving his residency.

He is not able to fulfill his military commitment as a medical doctor if he is not board certified. He is going through emotional stress coping with panic attacks and giving up his medical career.

What would be the options or consequences of his decision to stop his residency as far as the Air Force is concerned? He is sending a letter describing the situation, and his counselor is sending a letter as well.

Refering to turning ones self in after going AWOL what does an Article 15 punishment consist of?

My husband received a general officer article 15. He took his lumps, and now a different command is holding a board for his separation from the army. He is and officer and in the active guard reserve(agr). Since he received the article 15 while in theater under a different command, does the command he returned to have the authority to take such action?

Released after AWOL

If you are an officer and turn yourself in after going AWOL for less than 30 days how long is it until you are released? Will you be held in the briggs/jail until your punishment has been issued?

Awol/deserter from Fort Benning

Hello Sir, I am gone from Fort Benning since June, 2007. I was put on 30 days convalescent leave as had hair line fracture in my foot developed on week ten of OSUT . The difficult thing was I had no family in America to go, so got authorisation from my command to go to England where I have dual citizenship. There were alot of variables in me not going back at the time but ultimately it was my choice. I seek legal representation to negotiate my return to fort benning and to try whatever it takes to get me back into training. I wish to continue my career in the army and will take whatever punishment handed down to me, but just dont want to be dishcharged.

I have been in the Navy for 2 years and the command I am at is trying to send me to court marital for dating another student at the school I am stationed at. They say I broke a rule on the page 13 I signed, but the page 13 I signed specified no relationships in the barracks. It is now 10 months after we reported and we have a daughter together and this legal stuff is holding up the family care plan we can't complete. I am so tired of dealing with it that I offered my superiors the option of giving me an OTH dicharge so that it would all be over with in a timely manner. Can I get the OTH chaged to a general or an honerable discharge later? If so, how?
